New Delhi, The Supreme Court has asked its registry to stop calling the trial court a lower court. The court said that the record of the trial court should also not be called the record of the lower court.
Justice Abhay S. A bench of Justice Oka and Justice Ujjwal Bhuiyan passed this order while hearing the petition of two persons challenging the decision of Allahabad High Court. The High Court had rejected his plea against his conviction and life imprisonment in a murder case that took place in 1981.
The bench, in its order passed on February 8, said that it would be appropriate if the registry of this court stops referring to the trial court as the lower court. The record of the trial court should also not be called lower court record (LCR). Instead, it should be referred to as the Trial Court Record (TCR). Registrar (Judicial) should take cognizance of this order. The top court fixed August 6 for hearing the case. Both the petitioners have challenged the October 2018 order of the High Court, which had rejected their appeal and asked them to surrender before the court to serve the remaining sentence.
