Mayur writes, ‘In this regard both Anil Sharma and Mithun did not follow the correct procedure under copyright laws. To say that the rights of Uttam Singh’s compositions are with the music company, is also wrong because even if a composer has signed the agreement due to the pressure of the music company or for any other reason, according to the law he still has the moral rights of his own composition. According to Mayur Puri, the rights of the music compositions of the film ‘Gadar Ek Prem Katha’ can never be taken from its composers Uttam Singh and Anand Bakshi due to this reason. The music company may have the rights to recreate a song, but this does not exempt them from having to enter into a joint agreement between the new songwriters and the old songwriters to re-use the tune and words before doing so.
