In this regard, intellectual property rights expert Mayur Puri has written a whole thread on the social media platform X (formerly Twitter) enumerating the legal aspects of the whole matter. Mayur writes, ‘In this regard both Anil Sharma and Mithun did not follow the correct procedure under copyright laws. To say that the rights of Uttam Singh’s compositions are with the music company, is also wrong because even if a composer has signed the agreement due to the pressure of the music company or for any other reason, according to the law he still has the moral rights of his own composition. Do not end.
moral rights do not expire
According to Mayur Puri, the rights of the music compositions of the film ‘Gadar Ek Prem Katha’ can never be taken from its composers Uttam Singh and Anand Bakshi due to this reason. The music company may have the rights to recreate a song, but this does not exempt them from having to enter into a joint agreement between the new songwriters and the old songwriters to re-use the tune and words before doing so. Do not take Lack of agreement between Anand Bakshi’s successor Rakesh Bakshi and Uttam Singh and new creator Mithun is a big negligence in this matter.
Mithun heard the truth
Mayur, the dialogue writer of superhit films ‘Om Shanti Om’ and ‘Happy New Year’ and lyricist of dozens of popular songs, says, ‘Uttam Singh is absolutely right to be sad and to speak publicly about this.’ After this, Mayur took a dig at musician Mithun and wrote, ‘Dear Mithun, even if Uttam ji likes your songs, the music company cannot take away his rights from his composition. There should have been a four-party new agreement in this matter and you have failed to protect the rights of one of your superiors.
