New Delhi, Karkardooma Court has given relief to the youth accused in the case of changing name, befriending and raping. While framing charges against the youth, the court has removed the sections of rape and house breaking.
During the hearing, the court said that the complaint was filed when the relationship was not going on. Before this, both were having consensual relationship, hence it cannot be called rape.
A case has been registered in Karawal Nagar police station. Advocate Vikas Trivedi of accused youth Shahrukh said that on June 9, Karawal Nagar police station booked Shahrukh under sections of rape, house breaking, threatening and molestation (IPC, 376 (2) (N), A case was registered under Section 448, 354 (A, C, D) and arrested. The girl alleged that the young man had befriended her by changing her name on Instagram and raped her continuously since the year 2021. The accused had shared her personal photos and Made a video. In the year 2023, the girl came to know about his real name, after which she broke relations with the accused. On this the young man threatened her.
While hearing the false case of forcibly entering the house, the court found that the girl was already aware that she was having a relationship with him and both were with each other with consent. Apart from this, the allegation of forcibly entering the house is wrong, because the girl herself had called the young man. The court has removed the charges of continuous rape and forced entry into the house against the youth.
The complaint was filed when the relationship was not working. Before this, both were having mutual consent, hence it cannot be called rape. – Court’s comment
